I got a phone call today from my web hosting company. I have one week to send them a statement of copyright - that I own the rights to everything I've uploaded. As if I didn't have enough to do around here.
I assume a one-page letter would do it. They didn't talk like there were any suits or cease-and-desist orders in the offing. I think the presence of so many MP3 files sent up a red flag that I might be giving away the new Metallica album or something, and now they have to cover their legal butts.
But it does make me worry and wonder if Hallo Excentrico! has finally appeared on the sample police's radar. I'd avoided MySpace for that very reason. Well, that and it does my head in just looking at it. Anyway, I figure several scenarios are possible once I sort this letter out and send it off:
1. They are satisfied and go their merry way. 2. I have to take down the mix sets, and the remixes on my personal site that don't fall under parody or fair use. 3. I have to take down stuff like Big In Albania which makes extensive use of samples. 4. I have to take the whole site down, in which case I'll probably just move the label to archive.org. I didn't want to have to jump through someone else's hoops to make you guys' stuff available, but if I have to, I will.
The domain is paid for through March of next year. If I have to take HE! down, I won't be renewing it, and DV will need another host. Hopefully that will not happen, but if it does, you've all been warned.
So. Does anybody have experience with this? Do you agree with my sizing-up of the situation?

I wouldn't worry too much about it to be honest. Tell them that you either own the copywrite to everything, or that it's all covered under some like Creative Commons or whatever. Don't give them any further details or act defensive. I doubt they'll actually listen to any of the MP3s to try and work out if mixtapes have unlicenced songs or songs have undeclared samples. Chances are, they're under pressure from MPAA or whoever to do this sort of thing, but ultimately it's not really worth their effort to enforce it, or lose customers. Alternatively, I have heard of being being cut off no questions asked, but that doesn't happen very often afaik

Actually, this might have been some kind of "good cop-bad cop" tactic, IDK, but here's a snip of the conversation I had:
Him: So, is this stuff good? Me: *laughs* Well, I like to think so.... H: Who would you recommend? M: Well, I'm rather fond of Solypsis.... H: Yeah, I was looking at the Green Album, and the Cyan Album.... So, is this stuff like, breakcore or something? M: Mostly V/Vm-style experimental techno, it doesn't neatly fit any specific genre, really. I'd recommend the Purple Album to start with. H: Right on, this sounds like something me and my coworkers might actually be interested in listening to and passing around the office.
Now that's interesting, because they're based in Hopkinsville, Kentucky, and they brag that they don't outsource anything.

shame the mix sets had to go, but that's a minor loss compared to keeping the rest of the content live.
(although my noisy set mix isall my own work.)

I promise, it's all my tracks (a travel through 16 years of noise making ).
I think the only two tracks used that contain recognisable samples are my "bob the bilder" and soup dragons "i'm free" remixes. (both of which i think are on other downloads of mine, on your site.)

OK, I've heard nothing, and they should have gotten the letter by now. So I called customer service, and of course the peon who answered the phone at 8:30 PM knew jack about it. "Call back during the daytime when the copyright guy is here." Sigh. As soon as I know what's up and can get to an Internet connection (I do not have one at work), I'll pass it on.

I gotta take the site down, and all the audio from the DigiVom site. The links are gonna break. I need Mixo or iivix or somebody who knows how to update the DigiVom site to throw up (pardon the pun) something to explain the problem ASAP.
